1.About Cashout Kings

Cashout Kings (“Cashout Kings,” “CK,” “we,” “us,” or “our”) operates a buying and cashout platform through which eligible members may purchase qualifying products and submit those products to Cashout Kings for purchase, resale, or other disposition. Cashout Kings may publish purchasing opportunities (“Deals”) specifying eligible products, quantities, purchase requirements, cashout amounts, locations, deadlines, and other conditions.

Cashout Kings is operated by Sense Tech Distributors, Inc. CK is not affiliated with, sponsored by, endorsed by, or otherwise associated with any retailer, manufacturer, brand, or payment provider unless expressly stated.

2.Eligibility and Accounts

You must be legally capable of entering into a binding agreement to use the Services. You may not use the Services if doing so would violate applicable law or regulations. CK may restrict participation in certain Deals based on geographic location, account status, purchasing history, quantity limits, or other legitimate business criteria.

You agree to provide accurate, current, and complete information and are responsible for your account credentials and activity. Notify CK promptly if you believe your account has been compromised.

Unless expressly authorized by CK, each member may maintain only one CK account. Creating multiple accounts to bypass limits, restrictions, verification requirements, or other platform controls is prohibited.

3.Deals and Cashout Pricing

Current Deals may include the product and model, retailer, cashout price, quantity limits, deadlines, eligibility requirements, Drop-Off eligibility, dropshipping eligibility, approved receiving locations, shipping requirements, and other Deal-specific conditions.

Cashout pricing may change at any time before the price is locked. You are responsible for reviewing the current Deal before purchasing.

Unless a Deal states otherwise, the applicable cashout price becomes locked when the shipment receives the qualifying carrier scan specified by CK. Creating a label, scheduling pickup, dropping a package at an access point, or otherwise preparing a shipment does not necessarily lock the price. If the required scan occurs after a price change, CK may apply the updated price.

4.Deal Commitments

Certain Deals may require members to commit to purchasing a specified quantity. Commitments may include quantity requirements, purchase deadlines, shipping deadlines, product requirements, retailer requirements, and other Deal-specific conditions.

CK may restrict, cancel, or modify commitments when necessary due to inventory availability, pricing changes, suspected abuse, operational requirements, or other legitimate business reasons. Failure to fulfill commitments may affect your account, Deal eligibility, or future participation.

5.Product Eligibility and Condition

Unless a Deal states otherwise, products must be new, genuine, factory sealed, complete, undamaged, and eligible under the applicable Deal. Used, opened, refurbished, counterfeit, altered, tampered, incomplete, damaged, mismatched, or otherwise ineligible products may be rejected or receive a reduced cashout. CK may inspect products upon receipt.

6.Product Limits

CK may impose quantity limits on individual members, accounts, Deals, products, retailers, locations, or time periods. Limits may be changed at any time. A Deal’s current limit is the applicable limit at the time of purchase and/or submission, subject to Deal-specific terms.

Members may not use multiple accounts, identities, addresses, payment methods, or other means to intentionally circumvent CK limits.

7.Shipping Products to Cashout Kings

Members are responsible for properly preparing products for shipment. Products must be packaged securely enough to reasonably protect them during transportation. Members should use an appropriate shipping box, properly protect individual products, prevent movement inside the box, securely seal the package, remove or cover old labels, properly attach the CK label, and retain tracking information.

CK may hold a member responsible for damage resulting from inadequate packaging.

8.Shipping Labels and Insurance

When CK provides a shipping label, the label may include standard carrier insurance or other coverage as specified by CK. Unless otherwise stated, CK-provided UPS labels include $100 of standard UPS coverage. Additional insurance may be available at the rate specified by CK.

CK may assist with eligible shipping claims but does not guarantee approval. Coverage is subject to the carrier’s terms, exclusions, documentation requirements, and claim procedures. CK is not responsible for claims denied because of inadequate packaging, prohibited contents, inaccurate information, failure to follow carrier requirements, or other circumstances outside CK’s control.

9.Dropshipping

Certain Deals may allow products to be shipped directly from an approved retailer to a CK-approved receiving location (“Dropshipping”). Only Deals specifically identified as Dropship Eligible may be dropshipped.

Members must follow Deal requirements, use the approved destination specified by CK, submit required order and tracking information through the website, comply with retailer policies, and provide accurate information. Members may not attempt to circumvent retailer security systems, purchasing restrictions, identity verification, quantity limits, fraud controls, or other retailer policies.

CK is not responsible for retailer cancellations, refunds, order restrictions, delivery delays, lost retailer shipments, or other retailer actions.

10.Submissions

Members must submit required shipment, tracking, product, and other information through the CK website and are responsible for accuracy. A submission may include Deal, product, quantity, tracking, shipping, Drop-Off, order, and other information requested by CK.

Inaccurate, incomplete, or misleading information may result in delays, adjustments, rejection, account restrictions, or termination.

11.Drop-Offs

CK may make warehouse Drop-Off locations available. Availability is subject to capacity, scheduling, Deal eligibility, account status, and other requirements.

Members must submit a Drop-Off request through the CK website when required. A request is not approval to deliver products unless CK confirms it. Members must follow all approved Drop-Off instructions. CK may change, suspend, or discontinue Drop-Off availability at any time.

12.Receiving and Inspection

Upon receipt, CK may inspect and verify product identity, quantity, condition, eligibility, packaging, Deal requirements, and submission information.

CK generally attempts to process received shipments within one business day, but members should allow up to three business days. Shipments requiring additional review may take longer, including shipments involving damage, quantity discrepancies, mismatched products, unusual shipments, late shipments, or other exceptions.

13.Damaged, Missing, or Ineligible Products

If products arrive damaged, incomplete, missing, ineligible, or materially different from the submitted Deal, CK may reduce the cashout, reject the product, request information, hold the submission, return the product, or take other reasonable action.

CK may request photographs, shipping documentation, tracking, order information, or other evidence. Members should retain original packaging and other relevant materials until a damaged shipment is resolved.

If an item is determined to be unsellable and returned, the member may be responsible for return shipping and any handling fee disclosed by CK or the applicable Deal.

14.Cashout Balances

Once a submission has been processed and approved, the applicable cashout amount will be credited to the member’s CK Wallet, subject to adjustments.

CK may adjust balances to correct processing errors, duplicate credits, incorrect quantities or pricing, fraudulent transactions, returned or rejected products, or other discrepancies. Members may not attempt to withdraw funds they know or reasonably should know were credited in error.

15.Payments and Withdrawals

Members may request payment of available funds through payment methods supported by CK. Current payment methods may include PayPal and Wise ACH. Payment methods and availability may change.

CK generally processes valid withdrawal requests within one business day, but members should allow up to three business days. Delays may result from incorrect payment information, account verification, payment-provider restrictions, fraud or compliance review, banking delays, technical issues, or circumstances outside CK’s reasonable control.

Members are responsible for accurate payment information. CK is not responsible for delays caused by member-supplied errors or third-party payment providers.

16.Payment Providers

Payments may be processed through third-party providers, including PayPal and Wise. Members are responsible for complying with applicable provider terms.

CK does not control third-party payment providers and is not responsible for account holds, restrictions, verification, delays, fees, provider decisions, or outages. CK may request additional information when reasonably necessary to complete or verify a payment.

17.Fraud and Prohibited Activity

You may not use the Services for fraudulent, deceptive, abusive, unlawful, or manipulative activity. Prohibited activity includes false information; impersonation; multiple accounts to evade restrictions; limit circumvention; counterfeit or stolen products; altered or tampered products; manipulated tracking; fraudulent receipts or documentation; payment for products not shipped; duplicate-payment attempts; payment fraud; chargeback abuse; account sharing; bypassing CK security controls; bypassing retailer security or purchasing restrictions; exploiting website errors; manipulating pricing or account balances; unauthorized automated interference; or conduct intended to improperly obtain money, products, credits, or other benefits.

CK may investigate suspected violations.

18.Account Suspension and Termination

CK may suspend, restrict, or terminate an account when reasonably necessary, including for violations of these Terms, fraud or abuse, inaccurate information, limit circumvention, prohibited products, failure to satisfy Deal requirements, security risks, misuse, or unlawful activity.

CK may suspend an account while investigating suspected violations. Termination or suspension may prevent access to Services or Deals.

19.Website and Platform Availability

CK attempts to maintain reliable access but does not guarantee that the website will always be available, uninterrupted, error-free, secure, accurate, or free from delays. CK may temporarily suspend or modify Services for maintenance, updates, security issues, operational reasons, or other circumstances.

20.Website Information and Errors

CK makes reasonable efforts to maintain accurate website information. The website may occasionally contain typographical, technical, pricing, or other errors. CK may correct errors and, where appropriate, cancel or modify transactions affected by an obvious error.

CK may correct account balances, cashouts, Deals, or other information displayed incorrectly due to technical or administrative error.

21.Third-Party Services

Services may interact with retailers, shipping carriers, payment providers, authentication services, communication platforms, and other third parties. CK does not control third-party services and is not responsible for their availability, policies, actions, failures, or decisions. Third-party services may have separate terms and privacy policies.

22.Intellectual Property

The Cashout Kings name, trademarks, logos, website design, software, text, graphics, content, and other materials provided through the Services are owned by or licensed to CK and protected by applicable intellectual-property laws.

Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, reverse engineer, scrape, republish, or create derivative works from CK’s website, software, branding, or proprietary content.

23.User Content

If you submit reviews, feedback, testimonials, photographs, suggestions, or other content to CK, you represent that you have the right to provide it. You grant CK a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display such content for legitimate business, marketing, operational, or promotional purposes, subject to applicable law.

CK may remove content that violates these Terms or applicable law.

24.Privacy

CK’s collection and use of personal information is governed by the Cashout Kings Privacy Policy, which is incorporated into these Terms by reference to the extent permitted by law.

25.Taxes

Members are responsible for determining and satisfying tax obligations arising from participation in CK Deals, purchases, cashouts, payments, or other activities. CK may provide tax-related documentation when required by law. CK does not provide tax, accounting, or financial advice.

26.No Financial or Investment Advice

Information concerning margins, rewards, profitability, or purchasing opportunities is informational only. CK does not guarantee that any Deal will result in a profit. Actual profitability may be affected by retail prices, taxes, shipping costs, credit-card rewards, payment fees, availability, cashout pricing, limits, returns, delays, and other factors. Members are responsible for evaluating each purchase.

27.Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CK DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

CK DOES NOT GUARANTEE THAT ANY DEAL WILL REMAIN AVAILABLE; ANY CASHOUT PRICE WILL REMAIN AVAILABLE; ANY PRODUCT WILL BE ACCEPTED; ANY SHIPMENT WILL ARRIVE WITHOUT DAMAGE OR DELAY; ANY PAYMENT WILL BE COMPLETED WITHIN A PARTICULAR TIME; THE WEBSITE WILL BE ERROR-FREE OR UNINTERRUPTED; OR A MEMBER WILL MAKE A PROFIT.

28.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASHOUT KINGS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CK’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (1) THE AMOUNT CK PAID OR OWED TO YOU IN CONNECTION WITH THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM; OR (2) $100.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

29.Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Cashout Kings and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms; misuse of the Services; fraudulent or unlawful activity; violation of another person’s rights; violation of applicable law; or content or information you provide to CK.

30.Disputes; Court Litigation

The parties will attempt in good faith to resolve disputes informally before pursuing formal legal proceedings.

To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services, including their formation, interpretation, performance, breach, or termination, shall be brought exclusively in the state or federal courts located in Orange County, California. You consent to the personal jurisdiction and venue of those courts.

Nothing in this section prevents either party from seeking temporary, preliminary, or emergency equitable relief when necessary to protect rights or prevent immediate harm. To the extent required by applicable law, nothing in these Terms limits a consumer’s non-waivable statutory rights.

31.Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

32.Changes to These Terms

CK may update these Terms from time to time. When material changes are made, CK may provide notice through the website, email, Discord, or other reasonable means. Updated Terms become effective on the date specified. Continued use of the Services after the effective date constitutes acceptance to the extent permitted by law.

33.Severability

If any provision is determined to be invalid, unlawful, or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions remain in effect.

34.No Waiver

CK’s failure to enforce any provision does not constitute a waiver of its right to enforce that provision in the future.

35.Entire Agreement

These Terms, together with the Privacy Policy and any Deal-specific terms or policies incorporated by reference, constitute the agreement between you and CK regarding use of the Services. If a Deal contains terms that specifically differ from these Terms, the Deal-specific terms control with respect to that Deal.
